1) IronChests make sure you're getting the patch compatible with MC1.5.

2) You'll need the NetherOres patch.

You can change back to the old version if you go to \assets\minecraft\textures\items_alt1 and copy diamond_sword.png to \assets\minecraft\textures\items

It was changed because a lot of people said the diamond sword was too plain for the "top" weapon.

Well done for figuring it out Philipp, but for those who can't edit images they'll have to wait for Sphax to release an official fix as it's against the license to redistribute parts of the base texturepack.

how do you do that?
I use a self-made Photoshop action for doing the cube preview effect and after a small revision it's now ready to be shared. It's made with CS6, works on 512x512px images and comes with minimal instructions.

If it does it with Optifine, but not MCPatcher it may be the old Optifine bug where it flips textures for no reason when using CTM...
